These Terms of Service (the "Terms") are a binding agreement between you and Teos Games LLC ("Teos Games", "we", "us" or "our") and govern your use of the TEOS game, including the game client, the launcher, the game data files, the game servers, game accounts, the website at teos-game.com and every related service, update and patch (together, the "Service"). Please read them carefully. By creating an account, installing, launching or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and acceptance
1.1. You may use the Service only if you have reached the age of majority where you live, or if your parent or legal guardian has read and accepted these Terms on your behalf and supervises your use of the Service. A parent or guardian who accepts these Terms is responsible for the minor's use of the Service, including any purchases.
1.2. You may not use the Service if the laws that apply to you prohibit it, or if we have previously terminated your access.
1.3. You accept these Terms when you register an account, select "agree" or a similar option, or install, launch or otherwise use any part of the Service.
2. Other documents
The Server Rules and the Privacy Policy form part of these Terms. The Server Rules describe in-game conduct and the penalties for breaking it; the Privacy Policy describes how we handle personal data. Particular events, promotions or offers may have additional terms. If any of these documents conflicts with these Terms, these Terms prevail.
3. Accounts
3.1. You must give accurate information when you register and keep it up to date. You are responsible for keeping your login and password secret and for everything that happens under your account, whoever performs it. Tell us at once, at the address in section 20, if you believe your account has been accessed without your permission.
3.2. Your account is personal. You may not sell, buy, rent, lend, share, trade or otherwise transfer an account or access to it, or offer to do so.
3.3. Account and character names must not:
- contain sexual content, or refer to sexual violence or to the abuse of children;
- attack or demean a person or a group on the basis of race, ethnicity, nationality, religion, gender, disability or sexual orientation, or incite hatred against them;
- contain profanity or obscene or vulgar language;
- impersonate another person, including our staff;
- otherwise violate generally accepted standards of decency or the rights of others.
We may change or remove a name that breaks these rules.
3.4. We cannot always restore an account whose login data was lost or disclosed by its owner, but we will help where we reasonably can.
4. Ownership
4.1. The Service and everything in it belong to Teos Games LLC or to its licensors. This includes the game client and the launcher, the game servers and the website, the game data files and every patch, and all of the content they carry: source code, models, textures, animations, shaders, sounds, music, locations, maps, items, interface art, fonts we have licensed, text, dialogue, character and place names, logos and trade marks. All of it is protected by copyright and by other laws, and all rights that are not expressly granted in these Terms are reserved.
4.2. This ownership does not depend on these Terms and does not depend on whether a person has a game account. Anyone who holds a copy of the client, the launcher, a patch or a data file - however they obtained it, and whether or not they ever accepted these Terms - holds material that belongs to Teos Games LLC and may use it only with our permission.
4.3. "TEOS", the game's logos and the names of its content are our trade marks. You may not use them as your own, or in a way that suggests that we endorse, operate or are connected with something we do not.
4.4. If you send us an idea, a suggestion or a bug report, we may use it in the Service without payment, obligation or attribution. Do not send us anything you are not free to give us.
5. Your license
5.1. For as long as you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to:
- install and run the official game client and launcher on devices you own or control, and
- use the game data files, patches and game content solely by playing TEOS through the official client and launcher as we distribute them, for your own personal, non-commercial entertainment.
5.2. That is the whole of the licence. It is a licence to play the game, not a sale, and no ownership passes to you. It does not permit anything listed in section 6 or section 7, and it does not permit you to rent, lend, sell, sublicense, host or publish the client, the launcher or the data files, to charge anyone for access to them, or to use them in any other product, service, model or data set.
5.3. The licence ends automatically if you breach these Terms, if your account is terminated, or if we stop offering the Service. When it ends you must stop using the client, the launcher and the data files and delete the copies you hold.
6. Protected game data
6.1. The game data files we ship may be encrypted, and that encryption is a technological measure that protects our copyrighted works. This section applies to those files, to the patches, to the client and the launcher themselves, and to the content inside them, and it is what a notice that points at these Terms refers to.
6.2. Except as section 6.4 allows, or as we have permitted in writing under section 6.6, you may not:
- decrypt a data file, recover, derive, guess or extract the key that protects it, or circumvent, disable, weaken or work around that protection by any means;
- extract, unpack, dump, rip, export or convert game data or game content into any other form or format, whether from a file, from memory or from the graphics device;
- copy, publish, distribute, upload, share, sell or otherwise make available the data files, the client, the launcher, a patch, or any content taken out of them;
- create derivative works from our models, textures, animations, sounds, music, locations, text or other assets, or use them as training or reference data;
- reverse engineer, decompile, disassemble or otherwise attempt to discover the source code, file formats, algorithms or protocols of the client, the launcher or the data files, or data-mine them;
- use a debugger, a disassembler, a memory dump or memory editor, a code injector, a hook, a packet or API monitor, a graphics or shader capture tool, an emulator, a script, an automated tool, an AI assistant or an AI agent against the client, the launcher, the data files or the game protocol in order to do any of the things listed in this section 6.2;
- intercept, record, replay, alter, spoof or reimplement the game protocol, or operate or help operate a server that serves our game data or imitates our game servers;
- instruct, commission, pay, assist or enable any other person, service, tool or automated agent to do any of the above, or ask for or accept the result of their doing it.
6.3. You may not knowingly use, host, redistribute or build upon game data or game content that anyone obtained in a way this section forbids, whoever obtained it and wherever you found it.
6.4. Where the law that applies to you grants you a right that a contract cannot take away - for example the right to decompile a program for interoperability under Article 6 of Directive 2009/24/EC in the European Union, or an exemption to the anti-circumvention rules under 17 U.S.C. § 1201 in the United States - this section does not restrict that right, but only to the narrow extent that law requires. Before relying on such a right, ask us at the address in section 20 for the information you need: we may be able to give it to you, which usually makes the exercise of the right unnecessary. Everything in section 6.2 that is not covered by such a right continues to apply.
6.5. Our rights here do not rest on this agreement alone. The client, the launcher and the data files are also protected by copyright, by the laws that prohibit circumventing technological protection measures - including 17 U.S.C. § 1201 - and by the law of trade secrets. Those protections apply to anyone who holds our files, with or without an account and with or without these Terms.
6.6. No permission under this section is granted to players, modders, content creators, server operators, tool authors or any other third party. Permission can be given only in writing by Teos Games LLC; write to the address in section 20 to ask for it. Any permission we give is limited to what it says, is personal to the person we give it to, and may be withdrawn. Permission is never implied - not by our silence, not by the fact that a tool, a service or an AI assistant is able to do the thing, not by the data being present on your own device, and not by other people having done it without being stopped.
7. Fair play and conduct
7.1. While using the Service you may not:
- use or distribute cheats, trainers, bots, macros, automation, packet editors, modified or third-party clients, or any program or hardware that gives an advantage the game does not offer;
- exploit a bug, an error or an unintended behaviour of the game for gain; if you find one, report it to us;
- operate, advertise or play on an unauthorised server, or help anyone to run one;
- sell, buy, trade or advertise accounts, characters, in-game items or in-game currency for real money or other value outside the official store, or farm them for that purpose;
- disrupt the Service: flood or overload the servers, attack the network, probe or scan our systems, or use the Service to distribute malware or spam;
- harass, threaten, defraud or impersonate other players or our staff, or break the Server Rules.
7.2. The Server Rules describe in-game conduct in detail and the penalties for breaking it. A breach of this section or of those Rules may cost you items, currency, a character or the account.
8. Client integrity and anti-cheat
8.1. The client and the launcher check their own integrity and the integrity of the game as it runs, and report technical information to us about those checks and about the versions they run. The Privacy Policy describes what is collected.
8.2. We may decline to serve a client that we do not recognise as the unmodified official one, and we may record any interference with the Service. Interfering with the client, the launcher, the data files or the game protocol, or attempting to, may lead to the suspension or termination of your account and your access under section 12, without prior notice.
8.3. You may not disable, bypass, spoof or interfere with these checks or with the reports they send, and you may not represent a modified client as the official one.
9. Virtual items, purchases and refunds
9.1. In-game currency, items, services and other virtual goods are part of the game. You do not own them: you receive a limited, revocable licence to use them inside the Service, on the terms of section 5. They have no monetary value, are not your property, are not a deposit or a credit balance, and cannot be exchanged for money or anything of value outside the game.
9.2. A purchase is delivered to your account at once. By placing an order you ask us to perform immediately, and you agree that the service is fully provided, and of appropriate quality, at the moment the purchased currency, item or service reaches your account. Where the law gives you a right to withdraw from a distance contract, you agree that performance begins straight away and - to the extent the law allows you to - you give up that right once delivery is made.
9.3. Purchases are therefore not refundable once delivered, except where the law that applies to you requires a refund, or where we decide to give one. We will normally correct a charge that was duplicated, failed, was not authorised by the account's owner, or did not deliver what it was for. Write to us, at the address in section 20, from the address registered to the account, with the payment reference, and do so promptly.
9.4. You pay the fees, taxes, bank charges and currency conversion costs connected with a purchase. Payments are handled by third-party payment providers under their own terms, and we never see your full card details. A chargeback or a payment dispute raised without contacting us first may lead to the account being suspended until it is resolved.
9.5. We may change prices, offers and the contents of the store, and may change, rebalance, withdraw or stop supporting any virtual item or service, including one you have already bought.
9.6. Virtual currency and items end with the account: if the account is closed or terminated, or if the Service stops, whatever is unspent is lost and we owe no compensation for it, except where the law requires otherwise.
10. Your content and communications
10.1. You are responsible for everything you send through the Service - chat messages, game mail, character, guild and pet names, anything you write to us, and anything you post on the website. You must have the right to send it, and it must not be unlawful, infringing, hateful, threatening, obscene or deceptive.
10.2. By sending it, you grant us a worldwide, royalty-free licence to store, copy, display and use it as far as we need to in order to run, moderate and protect the Service. We may remove or edit anything that breaks these Terms or the Server Rules.
10.3. Game chat, game mail and the other channels inside the game are neither private nor secure. They may be logged, reviewed and kept by us to prevent fraud and to enforce these Terms, and they may be seen by other players. Do not use them for anything confidential, and never send your password to anyone, including someone claiming to be our staff.
11. Updates and changes to the Service
11.1. The client, the launcher and the data files update themselves. You agree to receive those updates and patches, and you may not block them, alter them, apply them selectively or keep playing on an older version where we require a newer one.
11.2. We may change the game at any time: add, alter, rebalance or remove features, content, items, maps, servers and the in-game economy; reset test servers; and limit or discontinue any part of the Service, or the Service as a whole. Where we can, we will announce changes in advance on the website.
11.3. We do not promise that the Service will be available without interruption. It needs maintenance, and it can be affected by faults, attacks and events outside our control.
12. Suspension and termination
12.1. We may suspend, restrict or terminate your account and your access to the Service, with or without prior notice, if we reasonably believe that you have breached these Terms - in particular section 6, 7 or 8 - or that doing so is necessary to protect the Service, other players or us, or is required by law.
12.2. When your access ends, the licence in section 5 ends with it: stop using the client, the launcher and the data files, and delete your copies. Virtual currency and items are treated under section 9.6.
12.3. You may stop playing at any time and ask us, at the address in section 20, to close your account.
12.4. Sections 4, 6, 9.1, 9.6, 10.2 and 13 to 19 survive the end of your account and of these Terms.
13. Health warning
The game contains flashing images, rapid changes of light and other visual and sound effects that may trigger seizures or other symptoms in people who are susceptible to them, including people who have never had a seizure before. If you have an epileptic or other neurological condition, consult a doctor before playing. Stop playing and seek medical advice if you feel dizzy, lose awareness, or experience altered vision, eye or muscle twitching, disorientation or convulsions. Take regular breaks.
14. Disclaimers
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or free of errors, that defects will be corrected, that items, characters or progress will be preserved, or that the Service will meet your expectations.
Nothing in this section limits any right you have as a consumer that the law does not allow us to exclude.
15. Limitation of liability
To the fullest extent permitted by applicable law, Teos Games LLC and its members, officers, employees and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunity, lost goodwill, or the loss of accounts, characters, items, currency or progress, however caused and on any theory of liability. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or fifty United States dollars.
Some jurisdictions do not allow some of these exclusions or limitations, and nothing here excludes liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded. In those cases our liability is limited to the minimum the law permits.
16. Indemnity
You will indemnify and hold harmless Teos Games LLC and its members, officers, employees and suppliers against any claim, demand, loss, liability or expense, including reasonable legal fees, arising out of your breach of these Terms, and in particular out of any act listed in section 6, out of your use of the Service, and out of anything you send or post through it.
17. Governing law and disputes
17.1. These Terms and any dispute arising out of them or out of the Service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules and without regard to the United Nations Convention on Contracts for the International Sale of Goods.
17.2. Before starting proceedings, please write to us at the address in section 20 and describe the dispute. We will try to settle it informally; if it is not settled within thirty days, either of us may go to court.
17.3. The state and federal courts sitting in the State of Delaware have exclusive jurisdiction over any dispute, and you consent to that jurisdiction and venue. We may nevertheless seek an injunction or other urgent relief - in particular against a breach of section 6 - in any court that can grant it.
17.4. If you are a consumer in a country whose law gives you the right to bring proceedings in your own courts, or gives you the protection of your own law, this section does not take that right away.
18. Changes to these Terms
18.1. We may change these Terms. The current version always appears on this page with its effective date, and we announce material changes on the website before they take effect. If you keep using the Service after a change takes effect, you accept it; if you do not accept it, stop using the Service and close your account.
18.2. The address of this page does not change. The notices in the client and in every data file point at it permanently, and earlier revisions of these Terms are kept and can be requested from us at the address in section 20. A copyright year printed in a notice or in a file refers to that file, not to the revision of these Terms that applies to you.
18.3. The English version of these Terms is the authoritative one. Translations are provided for convenience, and if a translation differs from the English version, the English version prevails.
19. General
19.1. If any provision of these Terms is held to be unenforceable, it is limited or removed to the minimum extent necessary and the rest of the Terms stay in force. In particular, if part of section 6 is unenforceable where you live, the remainder of section 6 continues to apply.
19.2. If we do not enforce a provision at once, we do not give up the right to enforce it later.
19.3. We may assign these Terms, in whole or in part, to an affiliate or to a successor in our business. You may not assign them or transfer your account.
19.4. These Terms, together with the Server Rules, the Privacy Policy and the terms of any particular offer, are the whole agreement between you and us about the Service, and replace any earlier user agreement.
19.5. We are not liable for a failure or delay caused by an event outside our reasonable control, including network and hosting failures, attacks, power cuts, acts of government and natural disasters.
19.6. We may give you notice by email to the address registered to your account, by a message in the game or the launcher, or by publishing it on the website. You give us notice by writing to the address in section 20.
19.7. Nothing in these Terms creates a partnership, agency or employment relationship between us, and they give no rights to anyone other than you and us.
